Temporary Local Planning Instruments

A Temporary Local Planning Instrument (TLPI) replaces parts of the planning scheme for a period of up to one year while the planning scheme is being amended. A TLPI is put in place when there is a significant risk of serious harm occurring under the current planning scheme.

 

Current Temporary Local Planning Instrument

Temporary Local Planning Instrument 01/2018 (dual occupancy)

The Temporary Local Planning Instrument (TLPI) 01/2018 will commence on 21 December 2018. The TLPI 01/2018 will cease to have effect on 21 December 2020 or when proposed Toowoomba Regional Planning Scheme Amendment No.16 comes into effect, whichever occurs first.

The purpose of TLPI 01/2018 is to ensure that development which is a dual occupancy creates pleasant, safe and attractive living environments while facilitating a range of housing types that sensitively blend with existing streetscapes and neighbourhoods and facilitate increased population within proximity to major centres.

The TLPI applies to the whole of the Toowoomba Regional Council planning scheme area.

Temporary Local Planning Instrument 01/2017 (dual occupancy)

The Temporary Local Planning Instrument 01/2017 (dual occupancy) (TLPI 01/2017) will commence on 4 December 2017. The TLPI 01/2017 will cease to have effect on 4 December 2018 or when the proposed Toowoomba Regional Planning Scheme Amendment No.16 comes into effect, whichever occurs first.

The purpose of TLPI 01/2017 is to ensure that development which is a dual occupancy creates pleasant, safe and attractive living environments while facilitating a range of housing types that sensitively blend with existing streetscapes and neighbourhoods and facilitate increased population within proximity to major centres.

The TLPI applies to the whole of the Toowoomba Regional Council planning scheme area.

1. Purpose of the Temporary Planning Instrument

1.1 The purpose of Temporary Local Planning Instrument (TLPI) 01/2015 (Charlton Wellcamp Enterprise Area – Intermodal Precinct) is to ensure that development is subject to consistent development provisions and appropriate levels of assessment that is consistent with the strategic intent of the Toowoomba Regional Planning Scheme 2012.

2. Duration of the Temporary Planning Instrument

2.1 This TLPI 01/2015 (Charlton Wellcamp Enterprise Area – Intermodal Facility Precinct) will have effect in accordance with the Sustainable Planning Act 2009 for a period not exceeding 1 year from 26 October 2015.

3. Application of Temporary Planning Instrument

3.1 This TLPI applies to Lot 1 on SP217792, Lot 170 on AG460, Lots 35 to 37 on SP175413, Lot 13, 19 and 27-29 on RP24609, Lots 99 to 101 on A345 and road as shown on the map in Appendix 1.

3.2 For the purposes of applying the Toowoomba Regional Planning Scheme, all of the area shown on the map in Appendix 1 is taken to be within the Medium Impact Industry Zone and the Charlton Wellcamp Enterprise Area Local Plan Intermodal Facility Precinct.

3.3 This TLPI suspends the operation of the following provisions of the Toowoomba Regional Planning Scheme:

Section 5.5 Levels of assessment – Material change of use

Section 5.6 Levels of assessment – Reconfiguring a lot

Section 5.9 Levels of assessment – Local plans

4. Definitions

4.1 A term in this instrument has the meaning given it by the Toowoomba Regional Planning Scheme.

5. Material Change of Use

5.1 To the extent that the operation of the Toowoomba Regional Planning Scheme in relation to a Material Change of Use is suspended by section 3.3, this TLPI applies the following provisions of the Toowoomba Regional Planning Scheme:

6. Reconfiguring a Lot

6.1 To the extent that the operation of the Toowoomba Regional Planning Scheme in relation to Reconfiguring a Lot is suspended by section 3.3, this TLPI applies the following level of assessment:


Exempt: If the Sustainable Planning Regulation 2009, schedule 4, table 3 applies.


Self-assessment: If rearranging the boundaries of a lot by registering a plan of subdivision.


Compliance assessment: If the Sustainable Planning Regulation 2009, schedule 18, table 1 applies


Code assessment: If: (i) rearranging the boundaries of a lot by registering a plan of subdivision; and (ii) not complying with or more self-assessable acceptable outcomes in the assessment criteria identified for self-assessment


Any other reconfiguring a lot not listed in this table

Temporary local planning instrument 01/2016 (building work - demolition or removal)

1. Purpose of the Temporary Planning Instrument

1.1 The purpose of Temporary Local Planning Instrument 01/2016 (Building Work – demolition or removal) is to ensure that demolition or removal of a heritage place is subject to an appropriate level of assessment.

2. Duration of the Temporary Planning Instrument

2.1 This temporary local planning instrument 01/2016 (Building Work – demolition or removal) will have effect in accordance with the Sustainable Planning Act 2009 for a period not exceeding 1 year from 19 August 2016 or until proposed
Toowoomba Regional Planning Scheme Amendment No.10 comes into effect, whichever occurs first.

3. Application of Temporary Planning Instrument

3.1 This temporary local planning instrument applies to the whole of the Toowoomba Regional Council planning scheme area.

3.2 This temporary local planning instrument suspends the operation of the following provisions of the Toowoomba Regional Planning Scheme:

5. Demolition or Removal

5.1 For the purposes of administering Section 5.7, Table 5.7:1 of the Toowoomba Regional Planning Scheme, to the extent it relates to the development ‘Demolition or Removal’, the following shall apply in addition to any other provisions of that Section not suspended by this temporary local planning instrument:


Exempt: Demolition or removal: Any other building work not listed in this table


Self assessment: Nil


Compliance assessment: Nil


Code assessment: Nil


Impact assessment: Demolition or removal, if:

(a) the building or structure is a Heritage place identified in SC6.6.2 of Planning Scheme
Policy No. 6 and is not a State heritage place and

(b) the building or structure is not a freestanding outbuilding and

(c) more than 25 m² of the Gross Floor Area is proposed to be demolished and/or removed.

OR

If the front half of a Neighbourhood character place identified in SC6.7.2 of Planning Scheme
Policy No. 7 (being any of the area identified as ‘A’ in Figure 1 below) and there is no
current approval for the replacement of the building proposed to be demolished or removed.
