Food trucks are businesses that operate out of self-contained mobile food vehicles in either private or public areas. Areas that are considered public and require our approval, include parks and roadside vending. To operate a mobile food vehicle in the Toowoomba Region you are required to have the correct licencing for a mobile food business. This licencing is accepted throughout Queensland for the operation of mobile food vehicles.

Depending on the location site of the operation of your mobile food vehicle, we have two different application processes:

  1. operating on a Council controlled area - roadside or carpark
  2. operating from a pre-approved location in a Council park.

The Food Act 2006 permits licenced operators to operate their food truck in any local government area in Queensland with a single licence.

Food trucks can apply to operate on Council roadsides and carparks under the mobile roadside vending clause in Subordinate Local Law No. 1.2 (Commercial Use of Local Government Controlled Areas and Roads) 2020, subject to some restrictions.

These restrictions include:

  • ensuring that operations are handled in a safe manner
  • food trucks are not going to impede foot and/or vehicle traffic
  • there is no introduction of unfair competition with existing fixed premises.

We allow a restricted number of mobile or temporary vendors to operate within selected parks on weekdays and weekends (subject to conditions). By allowing vendors to introduce food and beverages or services on a temporary basis into the park environment. Vendors will be required to express their interest for the right to operate in the identified parks.

We may consider a food truck to operate in the following parks:

  • Queens Park, East Toowoomba
  • Kearneys Spring Recreation Reserve, Toowoomba
  • Newtown Park, Newtown
  • Nell E Robinson, Kearney's Spring
  • Middle Ridge Park, Middle Ridge
  • Captain Cook Sporting Reserve, Wilsonton
  • Peacehaven Park, Highfields
  • Federation Park, Vale View
  • Lake Cooby, Loveday Cove
  • Lake Cressbrook
  • Bullocky’s Rest, Crows Nest
  • Back Creek Park, Millmerran.

Application process

Each application is reviewed on individual merits and assessed against criteria.

Application steps

  1. Refer to the Vendors in Council parks application guide. Please note - this process is not applicable if the vendor is trading as part of an approved temporary event in a Council Park.
  2. The applicant must forward the following mandatory documents to us:
    • completed Vendors in Council Parks permit application
    • copy of Certificate of the Registered Business Name
    • copy of public liability insurance
    • copy of the food licence
    • copy of vehicle and/or vehicle component Compulsory Third Party (CTP) Insurance
    • photo of vehicle setup and menu
    • any other supporting documents.

All documents and files must be supplied in Word, PDF or JPEG format.
